The short version

Use Construct PM for its purpose, keep your account secure, and pay for the plan you choose. You keep ownership of your projects. You can cancel at any time and keep access until the period you paid for ends.

The one thing worth reading in full is section 6. What this product produces is an estimate, not a professional engineering or architectural opinion, and it must not be the only basis for building, bidding, or signing anything.

This summary is for orientation only. The numbered sections below are the agreement.

1. Agreement

These terms are an agreement between you and Construct PM covering your use of Construct PM— the website, the application, and the API. By creating an account or using the service, you accept them. If you are agreeing on behalf of a company, you confirm you are authorised to bind it, and “you” means that company.

Our Privacy Policy forms part of this agreement.

2. Eligibility

You must be at least 18 years old and legally able to enter into a contract. You may not use Construct PM if a sanctions regime or other applicable law prohibits it.

3. Your account

Keep your credentials confidential. You are responsible for activity under your account, including anything done with an API token you have created. Tell us promptly at support@construct-pm.com if you believe your account has been compromised.

One account is for one person or one organisation. Sharing a single account’s credentials to give several people paid access is not permitted.

4. Plans, billing, and cancellation

Construct PM offers a free tier and paid plans, billed monthly or annually in advance through Stripe. Paid plans renew automatically at the end of each period at the then-current price until you cancel.

You can cancel at any time from your account. Cancelling stops the next renewal; your plan stays active until the end of the period you have already paid for, after which the account moves to the free tier. We do not provide partial refunds for time remaining in a period, except where the law requires one or where we have clearly got something wrong — if you think that has happened, write to us and we will look at it properly.

If a payment fails, we may suspend paid features until it is resolved. If we change prices, we will give at least 30 days’ notice by email before the change applies to your renewals.

Paid plans include usage limits, which are shown on the plans page. Reaching a limit pauses the metered feature for the rest of the period; it does not delete anything you have already made.

5. Your content

You keep ownership of everything you put into Construct PM and everything it generates for you from your input — your projects, plans, takeoffs, and estimates are yours.

You grant us only the permission we need to run the service: to store, process, and display your content back to you and to anyone you share it with. That permission ends when you delete the content or your account. We do not use your content to train models.

You are responsible for having the rights to what you upload, including drawings, photographs, and any personal information about other people such as subcontractor contact details.

6. Estimates are estimates

This section matters more than the rest, so it is written plainly.

Construct PM generates floor plans, quantity takeoffs, schedules, and cost estimates using automated models and general pricing data. These outputs are informational tools. They are not architectural drawings, structural engineering, a code-compliance review, a certified quantity survey, a formal appraisal, or a binding quotation.

Automated models make mistakes, including confident ones. Prices vary by region, supplier, and time. Nothing produced here has been reviewed or sealed by a licensed architect or engineer.

Before you build from it, bid on it, sign a contract based on it, or submit it to an authority, have the work checked by a qualified professional and confirm current prices with your suppliers. You are responsible for that verification. To the fullest extent the law allows, we are not liable for losses arising from relying on an output without it.

7. Acceptable use

You agree not to:

  • break the law, or infringe anyone’s rights, using the service;
  • upload personal information about others that you have no right to share, or use the notification features to send unsolicited marketing;
  • attempt to gain unauthorised access to the service, other accounts, or the systems behind them;
  • interfere with the service’s operation — including circumventing usage limits, rate limits, or billing;
  • resell or redistribute the service, or scrape it in bulk, without our written agreement.

8. Availability and changes

We aim to keep Construct PM available and improving, but we do not promise uninterrupted service. Features may be added, changed, or withdrawn. If we discontinue a paid feature you materially rely on, we will give reasonable notice and, where the change leaves you paying for something you can no longer use, a fair refund of the unused portion.

The service depends on third parties — payment processing, hosting, mapping, and weather data among them. Their outages become ours, and we are not liable for them beyond acting reasonably to restore service.

9. Disclaimers

Except where the law does not allow it, Construct PM is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that outputs will be accurate, complete, or suitable for your project.

10. Limitation of liability

To the fullest extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising out of these terms or your use of the service.

Our total liability for all claims in any 12-month period is limited to the amount you paid us for the service in the 12 months before the event giving rise to the claim, or US$100 if you paid nothing.

Nothing in these terms excludes liability that cannot lawfully be excluded — including for fraud, or for death or personal injury caused by negligence. Some jurisdictions do not allow certain limitations, in which case the limitations above apply only so far as that jurisdiction permits.

11. Indemnity

If you use Construct PM in breach of these terms or of the law, and that causes a third-party claim against us, you agree to cover the reasonable costs and damages that result. We will tell you promptly about any such claim and let you take part in its defence.

12. Suspension and termination

You may stop using Construct PM and delete your account at any time. We may suspend or terminate an account that breaches these terms, or that we reasonably believe presents a security or legal risk. Except where the breach is serious or the law prevents it, we will give you notice and a chance to put it right first.

If we terminate your account without cause, we will refund the unused portion of any prepaid period. After termination you can ask us for a copy of your project data for 30 days, after which it may be deleted.

13. Governing law

These terms are governed by the laws of the State of Illinois, United States, without regard to its conflict-of-law rules. Disputes will be brought in the state and federal courts located in Cook County, Illinois, and both parties consent to that jurisdiction. If you are a consumer, this does not deprive you of the protections of the mandatory law of the country where you live.

14. Changes to these terms

We may update these terms. For material changes we will update the effective date above and notify account holders by email at least 30 days before they take effect. Continuing to use Construct PM after that means you accept the new terms; if you do not, cancel before they take effect and we will refund the unused portion of your current period.

15. General

If a provision is held unenforceable, the rest stays in force. Not enforcing a term is not a waiver of it. You may not assign this agreement without our consent; we may assign it to a successor of the business. These terms, with the Privacy Policy, are the whole agreement between us about Construct PM.
